Refund Policy — LuvKaizen KOL Campaign Checkout

This Refund Policy forms part of, and must be read with, the Terms of Service. Capitalized terms have the meaning given there. It applies to KOL campaign packages (USD 5,000 / 10,000 / 20,000) purchased via the Checkout and paid in cryptocurrency through CoinGate.
Applies to businesses (B2B) only. These are business-to-business services. Statutory consumer withdrawal/"cooling-off" rights under EU consumer law do not apply.

2. The deposit (10%)
2.1 The 10% deposit funds roster-building work — sourcing, matching, availability checks, and preparing your proposed KOL roster.
2.2 The deposit is non-refundable once roster work has begun. Because roster work typically begins promptly after payment, you should treat the deposit as non-refundable from Order acceptance.
2.3 No cancellation window. We begin sourcing immediately on Order acceptance, so the deposit is non-refundable from that point. There is no grace period for the deposit.
2.4 The deposit is applied toward the total package price; it is not an additional charge.
3. Cancellation before roster delivery
If you cancel after roster work has begun but before we deliver the roster, the deposit is retained (Section 2) and no balance is due. You have no further payment obligation for that Order.
4. The balance (90%) — refund conditions
4.1 The balance authorizes execution (booking, briefing, scheduling, publishing, reporting). It is due after roster delivery and before execution.
4.2 If you cancel after paying the balance but before we commit any funds/bookings to KOLs, we will refund the balance less (a) any KOL fees or third-party costs already committed or non-recoverable, (b) reasonable work performed, and (c) non-recoverable crypto network/processor fees. whether to cap deductions or state a fixed cancellation schedule.
4.3 Once execution is underway, refunds apply only to the undelivered and uncommitted portion of the Services. Amounts allocated to KOLs who are booked, in production, or published are non-refundable.
4.4 Provider non-delivery. If we fail to deliver a materially agreed portion of the Services and cannot provide an equivalent substitute (per Terms §7.4), we will credit or refund the affected, undelivered portion at our discretion. This is your primary remedy for shortfall, subject to the liability cap in Terms §11.
4.5 No refunds for outcomes. Because we do not guarantee marketing or financial results (Terms §9), dissatisfaction with campaign performance (reach, engagement, conversions, token price, funds raised) is not a basis for a refund where the agreed deliverables were provided.
5. Crypto refund mechanics
5.1 Asset and amount. Approved refunds are paid in USDC, unless we agree another asset with you in writing, calculated on a USD-equivalent basis using the USD value credited to us at the time of your original payment. Because crypto prices fluctuate, the quantity of crypto returned may differ from the quantity you sent; we refund USD-equivalent value, not necessarily the same number of tokens.
5.2 Network and processor fees are deducted. Blockchain network (gas) fees and any CoinGate/processor fees incurred on the original payment and on the refund are non-refundable and are deducted from any refund.
5.3 Refund destination. Refunds are sent to the originating wallet where we can identify it, otherwise a wallet you confirm in writing. You are responsible for providing a correct, compatible receiving address on the correct network. We are not liable for losses from an incorrect address you provide.
5.4 Timing. Approved refunds are processed within 10 business days of approval, subject to network conditions and processor timelines.
5.5 AML/sanctions. Refunds are subject to sanctions and AML checks; we may withhold a refund where required by law or by CoinGate's requirements, or where the paying party cannot be verified.
6. No chargebacks (crypto is irreversible)
Cryptocurrency payments are final and irreversible and have no card-style chargeback mechanism. Any refund is made only under this Policy at LuvKaizen's determination. Attempting to reverse a settled transaction is not possible; disputes must be raised with us directly.
7. How to request a refund / dispute
7.1 Email matt@luvkaizen.com with your Order ID, the paying wallet/transaction hash, and the reason for the request.
7.2 We will respond within 5 business days and, where a refund is due, calculate it per Sections 4–5.
7.3 Unresolved disputes are handled under Terms §14 (governing law = Lithuania; exclusive jurisdiction of the courts of Vilnius, Lithuania).
